Innogenetics receives US$9.5m in settlement and licensing fees from Abbott Laboratories

Innogenetics (Euronext Brussels: INNX) announced today that it has concluded a US$9.5m settlement and licensing agreement with Abbott. The successful conclusion of this settlement resolves and ends the patent infringement lawsuit in the field of hepatitis C genotyping.

According to the agreement Abbott will receive a non-exclusive worldwide license to sell hepatitis C virus (HCV) genotyping products based on real-time PCR technology. Innogenetics will also receive undisclosed royalties for each hepatitis C test sold by Abbott worldwide during the patent term.

Abbott will also be given access to key Innogenetics patents in the area of HBV for the development and marketing of its own molecular diagnostic tests in return for undisclosed royalties.

Innogenetics (Euronext Brussels: INNX) a annoncé aujourd'hui la conclusion d’une transaction ainsi qu’un accord de licence avec Abbott pour un montant de US$9,5 millions. La conclusion positive de cet accord résout et met un terme au litige concernant le brevet dans le domaine du génotypage de l’hépatite C.

Selon l’accord Abbott obtiendra une licence mondiale non-exclusive pour la vente de produits de génotypage de l’hépatite C (HCV) sur base de la technologie PCR en temps réel. Innogenetics recevra aussi des redevances, pour un montant non divulgué, pour chaque test de génotypage de l’hépatite C vendu par Abbott dans le monde entier pendant la durée des brevets.

Abbott obtiendra également un accès aux brevets-clés d’Innogenetics dans le domaine de l’hépatite B, pour le développement et la commercialisation de ses propres tests diagnostiques moléculaires. En contrepartie Innogenetics recevra des redevances pour un montant non divulgué.

Innogenetics (Euronext Brussels: INNX) kondigde vandaag aan dat het een schikking- en licentieakkoord heeft bereikt met Abbott ter waarde van 9,5 miljoen US dollar. Het succesvol afronden van deze schikking beëindigt en lost het patentgeschil op in het domein van de genotypering van hepatitis C.

Volgens de overeenkomst zal Abbott een wereldwijde niet-exclusieve licentie verkrijgen voor de verkoop van hepatitis C virus (HCV) genotyperingsproducten op basis van real-time PCR technologie. Innogenetics zal ook royalty’s ontvangen voor elke hepatitis C test die wereldwijd door Abbott wordt verkocht gedurende de termijn van de octrooien. Financiële details werden niet bekendgemaakt.

Abbott zal ook toegang krijgen tot sleuteloctrooien van Innogenetics in het domein van hepatitis B. Deze rechten zijn voor de ontwikkeling en marketing van Abbott’s producten en in ruil verkrijgt Innogenetics niet nader genoemde royalty’s.
